本协议是您与 上海沐小阳网络科技有限公司(以下称"我们")之间就使用 Numable 应用及其桌面小组件、内容发布与分发服务(统称"服务")达成的协议。您注册、登录或以任何方式使用服务,即表示您已阅读、理解并同意受本协议及《隐私政策》约束。若您不同意,请停止使用。若您代表某组织使用,您声明已获得其授权。
These Terms form an agreement between you and Shanghai Muxiaoyang Network Technology Co., Ltd. ("we", "us") for use of the Numable app, its widgets, and content publishing/distribution (the "Service"). By registering, signing in, or otherwise using the Service you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
Numable 是一款本地优先的跨端小组件/仪表盘产品。您可浏览、安装、使用组件(xBundle),自定义仪表盘,并可将您创作的组件发布至社区供他人使用。组件展示的数据由应用在您设备上直接向第三方信息源获取(详见《隐私政策》§3)。我们保留在合理范围内新增、修改或停止部分功能的权利。
Numable is a local-first cross-platform widget/dashboard product. You may browse, install and use widgets (xBundles), build dashboards, and publish widgets you create to the community. Widget data is fetched directly from third-party sources on your device (Privacy Policy §3). We may add, change, or discontinue features within reason.
部分功能需通过 Apple 或 Google 登录。您应对账号下的活动负责,妥善保管登录凭据。登录为可选;匿名状态下大部分浏览与使用功能仍可用。您可随时注销账号。
Some features require Apple or Google sign-in. You are responsible for activity under your account and for safeguarding your credentials. Sign-in is optional; most browsing/use works anonymously. You may close your account at any time.
您承诺不利用服务从事:(a) 违反法律法规或损害国家安全、社会公共利益;(b) 侵犯他人知识产权、隐私、名誉等合法权益;(c) 上传或传播违法、色情、暴力、赌博、诈骗、恶意代码或误导性内容;(d) 未经授权访问、干扰、破坏服务或其安全机制;(e) 抓取、逆向、滥用接口或规避技术限制;(f) 冒充他人或虚假陈述。违反者,我们有权限制、暂停或终止其使用并依法追责。
You agree not to: (a) violate law or harm public interests; (b) infringe others' IP, privacy, or reputation; (c) upload or spread illegal, pornographic, violent, fraudulent, malicious, or misleading content; (d) access, disrupt, or damage the Service or its security; (e) scrape, reverse-engineer, abuse APIs, or bypass technical limits; (f) impersonate or misrepresent. We may restrict, suspend, or terminate access for violations.
5.1 内容归属与许可 — 您对自己发布的组件内容保留全部知识产权。为使我们能够分发,您授予我们一项全球范围、非独占、免许可费、可转授权的许可,用于在服务内存储、复制、分发、展示您的内容并对其打包/加密/签名以完成技术分发。此许可随您删除内容或注销账号而在合理技术周期内终止(已被他人安装的本地副本除外)。
5.2 声明与保证 — 您声明拥有发布内容的必要权利;内容不侵犯任何第三方权益、真实且不含恶意代码、遵守 §4。您对自己发布的内容独立承担责任。
5.3 平台角色:托管而非背书 — 我们是内容的技术托管与分发方,而非创作者或担保方。签名仅代表内容经由平台注册分发,不构成对内容质量、安全性、真实性的背书。社区层内容默认在受限沙盒中运行、能力降权,并带"未经审核"提示。您安装使用第三方内容前应自行判断风险。
5.4 举报、下架与申诉 — 任何用户可举报违规内容;达到阈值的内容将被软下架;我们可依审核结果决定移除或恢复;发布者可对下架决定提起申诉;我们可对严重或重复违规的发布者实施封禁(黑名单),被封禁账号将无法继续发布。
5.5 侵权通知 — 若您认为平台内容侵犯您的合法权益,请通过 §7 联系我们并提供:权利证明、被指内容的定位信息、您的联系方式及诚信声明。我们将依法处理。
(5.1) Ownership & license. You retain all IP in content you publish. To let us distribute it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, copy, distribute, display, and package/encrypt/sign it for technical delivery, ending within a reasonable window after you delete it or close your account (except copies already installed locally by others). (5.2) Warranties. You warrant you hold the rights to publish, the content infringes no third party, contains no malicious code, and complies with §4; you are solely responsible for it. (5.3) Host, not endorser. We are the technical host and distributor, not the author or guarantor. A signature means the content was registered for distribution — not an endorsement of quality, safety, or accuracy. Community content runs sandboxed with reduced capabilities and an "unreviewed" signal; assess the risk yourself. (5.4) Reports, takedown, appeals. Users may report; content past a threshold is soft-removed; we may remove or restore it; publishers may appeal; repeat/serious offenders may be banned and blocked from publishing. (5.5) Infringement notices. Send rights proof, the content's location, your contact, and a good-faith statement to §7.
除用户内容外,服务及其软件、界面、商标、Logo、文档等的知识产权归我们或相应权利人所有。未经许可,您不得复制、修改、分发或用于商业目的。本应用中的开源组件遵循其各自许可证。
Except for user content, all IP in the Service (software, UI, trademarks, logos, docs) belongs to us or the respective owners. You may not copy, modify, distribute, or commercialize it without permission. Open-source components remain under their own licenses.
服务可能展示来自第三方信息源的数据及其他用户发布的内容。我们不对第三方内容的准确性、合法性、可用性负责。您与第三方之间的交互及由此产生的风险由您自行承担。第三方数据的获取与使用另受该第三方条款约束。
The Service may display third-party data and other users' content. We are not responsible for its accuracy, legality, or availability. Your dealings with third parties and any resulting risk are your own; third-party data is also governed by that party's terms.

我们可能提供付费会员。价格、权益与订阅规则以购买页面展示为准。支付经 App Store / Google Play(或微信/支付宝)完成;自动续费、退款依相应渠道规则处理(详见《隐私政策》§6)。免费功能的核心可用性不因是否付费而被剥夺;付费主要解锁速度/数量/深度/同步等增值维度。我们保留调整定价与权益的权利,重大变更将提前告知。
We may offer paid membership; prices, benefits and rules are shown at purchase. Payment, auto-renewal and refunds are handled by the applicable channel (Privacy Policy §6). Core free functionality is not withheld; paid tiers unlock value-added dimensions (speed/quantity/depth/sync). We may adjust pricing/benefits with prior notice for material changes.
在法律允许的最大范围内:服务按"现状"和"现有"提供,我们不对适销性、特定用途适用性、不中断或无错误作默示担保。对于因使用或无法使用服务、第三方内容/信息源、数据丢失等造成的间接、偶然、特殊或后果性损失,我们不承担责任;我们的累计责任以您为使用服务在争议发生前 12 个月内实际支付的金额为限。本条不排除依法不可排除的责任。
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without implied warranties of merchantability, fitness, or uninterrupted/error-free operation. We are not liable for indirect, incidental, special, or consequential damages arising from use or inability to use the Service, third-party content/sources, or data loss; our aggregate liability is capped at the amount you paid in the 12 months before the claim. Nothing herein excludes liability that cannot be excluded by law.
我们可依合理需要变更、暂停或终止全部或部分服务。您可随时停止使用并注销账号。若您违反本协议,我们可暂停或终止您的使用。终止后,性质上应继续有效的条款(如知识产权、责任限制、争议解决)仍然有效。
We may modify, suspend, or terminate the Service in whole or part. You may stop and close your account anytime. We may suspend/terminate your access for breach. Clauses that by nature survive (IP, liability, disputes) continue after termination.
本协议的订立、效力、解释及争议解决适用中华人民共和国法律(不含冲突法规则)。因本协议产生的争议,双方应先友好协商;协商不成的,提交本公司住所地(上海市)有管辖权的人民法院诉讼解决。
These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-laws rules). Disputes shall first be resolved amicably, failing which they are submitted to the competent People's Court at the domicile of the company (Shanghai).

本协议构成双方就服务达成的完整协议。若任一条款被认定无效,不影响其余条款效力。我们未行使某项权利不构成放弃。我们可适时更新本协议,重大变更将在应用内显著告知;继续使用视为接受。
These Terms are the entire agreement. If any clause is invalid, the rest remain effective. Failure to enforce a right is not a waiver. We may update these Terms; material changes are notified prominently in-app, and continued use constitutes acceptance.
